Nanawagan sina Senador Kiko Pangilinan, Risa Hontiveros, at Bam Aquino sa Korte Suprema na “i-reconsider” nila ang kanilang hatol ukol sa impeachment case ni Bise Presidente Sara Duterte.
“We respectfully disagree with the Supreme Court’s ruling that halted the Senate’s constitutional duty to try the impeachment complaint against Vice President Sara Duterte,” saad ng mga Senador sa isang joint statement, July 28.
Anila, marapat lamang na magpatuloy ang pagpapatalsik sa Bise Presidente sa ilalim ng “The Fairness Principle” at “The Doctrine of Operative Facts.”
Ang “The Fairness Principle” ay tumatalakay sa sistema na kung saan, hindi dapat masasaid sa katarungan ang isang tao sa laban sa kanyang ginawa kung ang batas.
Ang “Fairness Principle” ay tumatalakay sa sistema na kung saan ay dapat sundin ng korte ang batas batay sa panahon na ginawa ng isang tao ang isang bagay, at hindi batay sa bagong batas o interpretasyon ng batas.
Samantala, ang “Doctrine of Operative Facts” naman ay ang pagiging epektibo ng lumang interpretasyon ng isang batas, kahit pa may bago ng interpretasyon dito.
Ayon sa mga Senador, nagagamit nang buo ang kapangyarihan ng lahat ng sangay ng gobyerno kapag isinaalang-alang ang mga ito.
“The powers of the Court, the House of Representatives, and the Senate must all be given proper and balanced effect,” saad nila.
Dagdag pa nila, hindi sila nanumpa sa tungkulan upang maprotektahan ang Konstitusyon at ang mga Pilipino.
“We did not swear an oath only to protect positions by way of technicalities. We swore to protect the Constitution–and the right of every Filipino to demand truth and justice,” ayon sa mga Senador.
